The Asphalyn platform (the "Platform", "Service") is operated by Muhammad Uzair, trading as Asphalyn ("Asphalyn", "we", "us", or "our"). By creating an account or using the Platform, you agree to these Terms & Conditions ("Terms"), our Privacy Policy, our Cookie Policy, and, where applicable, the Data Processing Agreement. If you do not agree, do not use the Platform.
If you are using Asphalyn on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.
Asphalyn is a cloud-based platform designed to help Process Safety Engineers, HAZOP Consultants, and other process safety professionals manage HAZOP studies, LOPA analyses, incidents, actions, attachments, comments, and related workflow data.
The platform is intended to improve organization, documentation, collaboration, and traceability throughout the engineering workflow. It is a record-keeping and workflow tool only, as described further in Section 4.
Asphalyn is an engineering productivity and facilitation tool — not an engineering authority, safety system, or decision maker.
The platform helps users document, organize, track, and manage engineering information. It does not replace engineering judgment, company procedures, regulatory requirements, independent hazard and risk assessments, independent verification, qualified review, competent-person sign-off, or professional/regulatory approval.
Every HAZOP study, LOPA analysis, incident record, action, recommendation, report, calculation, risk ranking, or any other output generated, stored, imported, or exported through Asphalyn must be independently reviewed and approved by appropriately qualified and competent personnel before implementation or reliance.
Asphalyn does not perform, validate, or certify engineering calculations, risk determinations, or regulatory compliance. Any risk matrices, severity/likelihood scales, PFD values, or acceptability conclusions configured or displayed within the platform are inputs and outputs of your own engineering process, not determinations made or validated by Asphalyn.
You remain solely responsible for all engineering decisions, operational changes, and the safe implementation of any work performed using information contained within the platform.
Content displayed in Asphalyn is provided for workflow support only. It is not legal, regulatory, engineering, safety, or professional advice, and must not be treated as a substitute for advice from a qualified process safety professional or regulatory authority.
You must use your own professional judgment and applicable internal procedures before acting on any output from the platform.

Paid plans are billed through our payment processor, Paddle, acting as merchant of record. By subscribing, you agree to Paddle's applicable terms in addition to these Terms.
For full payment and subscription terms, including renewal, cancellation, fees, payment terms, taxes, and billing frequency, please refer to Paddle's buyer terms. The following summary applies:
Paid subscriptions to Asphalyn are processed by Paddle.com Market Ltd ("Paddle"). Paddle acts as the merchant of record for all transactions. Paddle provides all customer service inquiries related to payments and handles all returns and refunds.
By purchasing a paid subscription, you agree to Paddle's buyer terms in addition to these Terms. The price charged at checkout is the price displayed on our pricing page. Applicable taxes are calculated and collected by Paddle as required by the jurisdiction of the purchaser.
Refunds are governed by our Refund Policy, which forms part of these Terms. When a full refund is issued, the associated subscription is canceled immediately rather than at the end of the current billing period, as described in Section 15 and the Refund Policy. Partial refunds issued by Paddle do not affect the subscription.
Asphalyn may offer different plans or feature levels. Certain features may be available only to specific plans or account types.
Plan structures, feature availability, and pricing may change as the product evolves.
Fair use of exports. Paid plans include “unlimited” exports within the bounds of normal usage. We do not impose a hard cap on exports, but if your usage is significantly above normal patterns, we may contact you to discuss your needs. We will not silently throttle or block your exports.
Free-plan export credit. Each Free-plan workspace is entitled to one PDF export of a HAZOP study for the lifetime of the workspace. This credit is not renewable per study and is consumed after a successful export. Word, Excel, CSV, and standalone register exports are not available on the Free plan.
As between you and Asphalyn, you retain all rights to the HAZOP studies, incidents, actions, comments, attachments, and other data you create or upload ("Customer Content"). You grant us a limited license to host, process, transmit, and display Customer Content solely to provide, maintain, and improve the Service.
You are solely responsible for the accuracy, legality, and appropriateness of Customer Content, and for having any necessary rights to upload it (including attachments and files containing third-party or personal information).
Asphalyn is operated by a small team. The same individuals who build and operate the platform also have administrative access to the infrastructure that stores Customer Content. We want this to be explicit rather than implied.
What this means: Customer Content is stored on infrastructure that Asphalyn personnel can technically access. We do not use end-to-end encryption, and we do not currently offer customer-managed encryption keys, bring-your-own-key, or per-tenant database isolation. Customer Content is encrypted in transit (TLS) and at rest on our infrastructure providers, but the platform operator is a party to that data.
We will not access, read, copy, export, or examine the content of your workspace data except:
We do not use Customer Content to train models, to advertise, to build competing products, or to share with third parties. We do not sell access to workspace data. Operators, employees, and contractors, if any, are bound by confidentiality obligations. Administrative actions on production systems are logged where the platform supports logging.
If your organization requires stronger isolation than Asphalyn currently provides (for example, under an NDA with an operator that prohibits third-party operators from having technical access to client studies), please contact us at contact@asphalyn.com before uploading that data. We would rather have that conversation upfront than discover it later. Our Privacy Policy describes the same access model in more detail.
Asphalyn uses third-party infrastructure and service providers ("subprocessors") to operate the Service. Our current subprocessor list, including the purpose, location, and international transfer mechanism for each provider, is published at /subprocessors.
We will notify workspace owners by email at least 30 days before adding a new subprocessor that processes personal data. During that period you may object to the change by contacting us at contact@asphalyn.com. If you object and we cannot accommodate your objection, you may terminate your subscription without penalty before the change takes effect.
Where required, we enter into a Data Processing Agreement with each subprocessor that imposes the same data protection obligations on them as are set out in our Data Processing Agreement. A copy of a subprocessor's DPA can be requested by emailing contact@asphalyn.com.
We process personal data in accordance with our Privacy Policy, which describes the categories of personal data we collect, the purposes for which we process it, the legal bases we rely on, and your rights.
POPIA (South Africa). Asphalyn processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Our Information Officer is Muhammad Uzair, who can be contacted at contact@asphalyn.com. You have the right to lodge a complaint with the South African Information Regulator at inforegulator.org.za, or by emailing POPIAComplaints@inforegulator.org.za.
GDPR and UK GDPR. Where applicable, we act as a data processor for customer workspace data and as a data controller for account and billing data. Our Data Processing Agreement governs the processor relationship and is accepted by using the Service.
Data loss. Our backup procedures are described on our Security & Trust page. We do not guarantee recovery of any specific data. You are responsible for maintaining independent copies of any data you cannot afford to lose.
Unless otherwise stated, Asphalyn, including its software, branding, design, documentation, and content, is the intellectual property of Muhammad Uzair, trading as Asphalyn and is protected by applicable copyright and intellectual property laws.
You may not copy, distribute, modify, or create derivative works from the platform except as expressly permitted by law or by written permission.
We strive to keep Asphalyn available and reliable. However, we do not guarantee uninterrupted availability, error-free operation, or that the service will always be free from delays, defects, or interruptions.
The platform may be temporarily unavailable due to maintenance, testing, updates, provider outages, or unforeseen technical issues.
Some features may be labeled, released, or treated as beta, experimental, preview, or early access functionality. Such features may change, break, be removed, or produce unreliable results at any time without notice. You use them at your own risk and should not rely on them for critical engineering records without independent verification.
We may suspend or terminate your access to the Service, with or without notice, for the following reasons:
You may cancel your subscription at any time; a manual cancellation takes effect at the end of the current billing period. Upon termination, your right to access the Service ends, though we may retain data for a limited period as described in our Privacy Policy.
Full refunds and chargebacks end access immediately. When a full refund is issued or a chargeback is initiated with your card issuer, the associated subscription is canceled immediately rather than at the end of the current billing period. In that case, your workspace is moved to a restricted, read-only state: you can view and export the data already in the workspace, but creating or editing new content is disabled. Your data is not deleted. If you choose to resubscribe, full access is restored without loss of data or reconfiguration. Partial refunds do not trigger this state.
Asphalyn is provided on an "as-is" and "as-available" basis.
To the maximum extent permitted by applicable law, in no event will Asphalyn, Muhammad Uzair, trading as Asphalyn, or its officers, employees, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to your use of, or inability to use, the Platform, even if advised of the possibility of such damages.
Asphalyn's total aggregate liability arising out of or relating to these Terms or the Service will not exceed the total fees paid by you to Asphalyn for the Service in the twelve (12) months preceding the event giving rise to the claim.
This includes any loss, corruption, misinterpretation, delay, misuse, or reliance on information stored, generated, exported, imported, or displayed within the platform. In particular, Asphalyn is not responsible for engineering decisions, operational outcomes, process safety incidents, injuries, fatalities, property damage, environmental harm, regulatory actions, fines, or business losses resulting from how you use the platform or rely on its outputs, including outputs that were not independently reviewed and approved as required by Section 3.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
To the maximum extent permitted by law, Asphalyn disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the platform will meet your requirements, operate without interruption, produce error-free or complete results, correctly calculate or represent risk, or be suitable for any particular engineering, legal, operational, or regulatory purpose. No advice or information, whether oral or written, obtained from Asphalyn creates any warranty not expressly stated in these Terms.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Asphalyn, Muhammad Uzair, trading as Asphalyn, and its officers, employees, and contractors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at contact@asphalyn.com. If the dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Pakistan.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Assignment. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including provider outages, natural disasters, or internet disruptions.
Entire Agreement. These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, Data Processing Agreement, and Subprocessor List, constitute the entire agreement between you and Asphalyn regarding the Service.
These Terms & Conditions may be updated as Asphalyn continues to evolve. For material changes, we will provide reasonable notice (such as an email or in-app notice) before they take effect. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.
