Acceptance of Terms

By creating an account, accessing a demo workspace, or using Asphalyn, you agree to these Terms & Conditions. If you do not agree, do not use the platform.

Purpose of Asphalyn

Asphalyn is a cloud-based platform designed to help Process Safety Engineers, HAZOP Consultants, and other process safety professionals manage HAZOP studies, nodes, incidents, actions, attachments, comments, and related workflow data.

The platform is intended to improve organization, documentation, collaboration, and traceability throughout the engineering workflow.

Current Product Status

Asphalyn is currently in an active MVP+ stage of development. New features, improvements, fixes, and changes may be introduced regularly.

While we work to provide a reliable experience, you may occasionally encounter bugs, incomplete functionality, maintenance periods, or changes to existing features as the platform continues to evolve.

Engineering Responsibility

Asphalyn is an engineering productivity and facilitation tool — not an engineering authority or decision maker.

The platform helps users document, organize, track, and manage engineering information. It does not replace engineering judgment, company procedures, regulatory requirements, risk assessments, independent verification, qualified review, or professional approval.

Every HAZOP study, incident record, action, recommendation, report, analysis, or any other output generated, stored, imported, or exported through Asphalyn must be reviewed and approved by appropriately qualified personnel before implementation or reliance.

You remain solely responsible for all engineering decisions, operational changes, and the safe implementation of any work performed using information contained within the platform.

No Professional Advice

Content displayed in Asphalyn is provided for workflow support only. It is not legal, regulatory, engineering, safety, or professional advice.

You must use your own professional judgment and applicable internal procedures before acting on any output from the platform.

User Responsibilities

When using Asphalyn, you agree to:

  • Provide accurate account and workspace information.
  • Maintain the security of your account credentials.
  • Use the platform responsibly and lawfully.
  • Review all engineering information before relying on it.
  • Comply with your organization's procedures and applicable regulations.
  • Not rely on demo data, sample outputs, or templates as final engineering records.

Demo Workspace

Demo workspaces may contain sample or simulated data for evaluation purposes only.

Demo workspaces may be reset, cleared, overwritten, migrated, or deleted at any time as part of the product experience. You should not rely on demo data as permanent storage.

Acceptable Use

You must not:

  • Attempt unauthorized access to Asphalyn or its systems.
  • Disrupt, interfere with, or attempt to degrade platform operation.
  • Upload malicious software, harmful content, or unlawful materials.
  • Reverse engineer, copy, or misuse the platform except where permitted by law.
  • Use Asphalyn for unlawful, fraudulent, or harmful activities.

Intellectual Property

Unless otherwise stated, Asphalyn, including its software, branding, design, documentation, and content, is the intellectual property of Asphalyn and is protected by applicable copyright and intellectual property laws.

You may not copy, distribute, modify, or create derivative works from the platform except as expressly permitted by law or by written permission.

Service Availability

We strive to keep Asphalyn available and reliable. However, we do not guarantee uninterrupted availability, error-free operation, or that the service will always be free from delays, defects, or interruptions.

The platform may be temporarily unavailable due to maintenance, updates, provider outages, or unforeseen technical issues.

Beta and Experimental Features

Some features may be labeled, released, or treated as beta, experimental, preview, or early access functionality.

Such features may change, break, or be removed at any time without notice. You use them at your own risk.

Limitation of Liability

Asphalyn is provided on an as-is and as-available basis.

To the maximum extent permitted by applicable law, Asphalyn and its owner shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the platform.

This includes any loss, corruption, misinterpretation, delay, misuse, or reliance on information stored, generated, exported, imported, or displayed within the platform.

In particular, Asphalyn is not responsible for engineering decisions, operational outcomes, safety incidents, regulatory actions, or business losses resulting from how you use the platform or rely on its outputs.

Disclaimer of Warranties

To the maximum extent permitted by law, Asphalyn disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will meet your requirements, produce error-free results, or be suitable for any particular engineering, legal, operational, or regulatory purpose.

Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Asphalyn and its owner from claims, losses, liabilities, damages, costs, and expenses arising out of your use of the platform, your content, or your violation of these Terms.

Changes to These Terms

These Terms & Conditions may be updated as Asphalyn continues to evolve. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.
